Your Privacy Rights

This Policy describes how Berlin Rosen LLC, an Orchestra Group LLC company (“Orchestra”), (collectively with Orchestra and its parent companies, subsidiaries, and affiliates, “we,” “us,” and “our”) treats personal information we collect from or about you, including on the websites where this Policy is located. By accessing or using our sites, or interacting with us, you acknowledge these practices.

1. We collect information from and about you.

We collect, receive, and create several categories of personal information about you, depending on how you interact with us:

We collect contact information, including your name, email address, job title, company name, phone number and mailing address, when you contact us or as part of providing services to you.

We collect Internet and network activity information. If you use our website, we may collect information about your browser, IP address, and device identifiers. We might look at pages that led or referred you to our site. If you click certain links on our site, we may see what site you visit when you leave. We may track the areas of the site you visit and for how long, what links you visited, and what pages or content you view and click on. We also look at how often and when you visit. We collect this information using the tracking tools described below. Third parties help us collect information this way. For more information about controlling those tools, please read Section 5 below.

We collect general location information using your ZIP code or IP address.

We collect other information you submit or send when you contact us or make a request.

We may develop inferences about your interests and preferences, based on the personal information we collect.

2. We collect information in different ways.

We collect personal information about you from various sources, including:

We collect information directly from you, including information you provide as you visit our site or contact us, at industry events, or while providing services to you.

We collect information from your devices. We use tracking tools like browser cookies, pixels, tags, and web beacons to collect information from and about you when you interact with our websites, our ads, and our emails. We may also have other third parties collect personal information on our behalf, such as Google Analytics and HubSpot tools. We get information about you from service providers we hire to work on our behalf and from other third parties. This includes service providers that host or maintain our websites and databases or send emails on our behalf. Social media and business networking platforms, such as LinkedIn may also give us information about you.

We combine information. For example, we may combine information that we have collected offline with information we collect online. Or we may combine information we get from a third party with information we already have. We may also aggregate your information with other individuals’ information to understand preferences and trends over time.

3. We use information as disclosed and described here.

We use the categories of personal information described above for the following purposes:

We use information to provide our services and communicate with you. For example, we may contact you about your requests and our services. We also use information to contact you about your feedback or other matters related to our relationship with you (including this Policy or our Website Terms of Use).

We use information for marketing purposes, including for targeted advertising. We use contact information to send marketing emails. We (and third parties) also display targeted advertising, cross-context behavioral advertising, and interest-based advertising using information from tracking tools and inferences gathered about you over time and across websites, apps, or other platforms. These are ads that we or our partners think are relevant based on your browsing habits or online activities. Our ads are about our services. Some of the tools we use help other third parties decide what ads you see, including ads about other companies’ products and services. These ads can be served on websites, in apps, and in emails. We and our third-party partners gather this information about you from the cookies, pixels, tags, web beacons, and other tools described in this Policy. Our third-party partners may link your name, email address, or phone number to other information they collect. To learn more about the partners involved in these practices, read Section 4 below. Sharing your information in connection with these advertising activities may be considered a “sale” or “sharing” as defined under certain privacy laws. We use information to improve our products and services. We may use your information to make our sites and offerings better, customize your experience with us, or conduct analytics.

We use information to comply with our obligations and administer our site and services. This might include troubleshooting, fraud detection, or testing on our sites or developing statistics.

We use information for safety, security, compliance, and due diligence purposes. We may use information to protect our company, sites or services, as well as to detect and investigate activities that may be illegal or prohibited. We will use certain pieces of personal information to verify your identity if you make requests pursuant to this Policy.

We use information as otherwise disclosed or permitted by law, or as we may notify you from time to time. For example, we use aggregated and de-identified data as permitted under applicable laws. We do not attempt to re-identify de-identified data, except as permitted or required by law.

4. We share your information with others.

We share information within the Orchestra corporate family, including with our subsidiaries, parent companies, owners, and affiliates.

We share information with service providers who perform services on our behalf, including vendors who send emails for us, help operate our websites or databases, or provide services. We may also share information with service providers that help us investigate and prevent data incidents or audit our business and financial statements.

We may share your information with our advertising partners, including for targeted advertising. We may share limited contact information (such as hashed email addresses) and Internet and network activity information with third-party advertising platforms, such as LinkedIn, to help us show ads to relevant audiences on those platforms. These partners use this information to match users on their services and deliver our ads. These partners may process data in accordance with their own privacy policies. We will share your information to comply with the law or to protect ourselves, our users, and others. For example, we may share information to respond to a court order or subpoena or governmental inquiry, or to investigate fraud. We might also share your information in order to enforce our terms.

We may share your information with a successor to all or part of our business. We may share your information if there is a change to our corporate structure or ownership and as part of a due diligence process.

We may share information for other reasons we may describe to you from time to time as permitted by law. For example, we share aggregated and de-identified data as permitted under applicable laws.

5. You have certain choices about how we use your information and targeted advertising.

You can opt out of receiving our marketing emails. To stop receiving our marketing emails, you can follow the unsubscribe instructions in any marketing message you get from us. If you opt out of marketing emails, we may still send you transactional emails, including responses to your questions or emails related to services you request.

You can control certain cookies and tracking tools such as browser cookies, device identifiers, and pixels. Your browser may give you the ability to control cookies, depending on the type of cookie. Certain browsers can be set to reject browser cookies. You can opt out of certain interest-based advertising at www.aboutads.info/choices and optout.privacyrights.info. Certain choices you make are browser- and device-specific. Your selections are deleted whenever you clear your cookies or your browser’s cache.

You can opt out of sale/targeted advertising and you can disable interest-based advertising. We do not “sell” personal information for money, but we do work with third parties to target ads. This may be “targeted advertising,” “cross-context behavioral advertising,” or “interest-based advertising,” as these terms are defined under certain applicable laws and frameworks. We describe this in more detail in Sections 3 and 4, above.

  • To opt out of the sale / use of your personal information on our site for targeted advertising or interest-based advertising purposes, you can click the “cookie” icon in the bottom left corner of each page of our sites. Again, options you select are browser and device specific. If you use a different device, change browsers, or delete the opt-out cookies, you may need to opt-out again.

Our Do Not Track Policy: Some browsers have “do not track” features that allow you to tell a website not to track you. We will respond to opt-out preference signals to the extent required by law for your browser or device, but we cannot link this information to an account and we do not respond to older, non-uniform “do not track” signals. Your selections are specific to the device, website, and browser you are using, and are deleted whenever you clear your browser’s cache. If you block cookies, certain features on our sites may not work. If you block or reject cookies, not all of the tracking described here will stop.

6. Your U.S. State Privacy Rights.

If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. To make a request, please send us an email at techsupport@orchestraco.com. Indicate in your request that you are a California resident making a “Shine the Light” inquiry.

You can also make certain requests regarding your “Personal Information.” (We use this term, and other terms in this section, as they are defined under applicable laws.) We honor requests in accordance with and to the extent required by applicable laws, which may vary depending on where you live.

  • Access / Know – You can request to access or confirm the processing of your personal information, and you can request a list of the third parties to which we disclosed Personal Information. You can also see this list in our Cookie Policy. We will provide your information in a portable and (to the extent technically feasible) a readily usable format.
  • Deletion – You can request that we delete your Personal Information that we maintain about you, subject to certain exceptions.
  • Correction – You can request that we correct inaccurate personal information that we maintain about you.
  • Opt-out of sale / sharing / targeted advertising – You can request that we not sell your Personal Information by clicking the “cookie” icon in the bottom left corner of each page of our sites, or by clicking the “Do Not Sell or Share My Personal Information” link in the site footer. For purposes of this Policy, “sell,” “sharing,” and “targeted advertising” have the meanings set forth under applicable law, and are subject to certain exceptions. Your selections are specific to the device, website, and browser you are using and are deleted whenever you clear your cookies or browser’s cache. We don’t have actual knowledge that we’ve sold or shared the personal information of consumers under 16 years of age.
  • Appeal – You can appeal our decision to techsupport@orchestraco.com with “Attention: Privacy Appeal” in the subject line.

You can make a request by emailing us at techsupport@orchestraco.com. We will not discriminate against you because you made any of these requests. We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps may vary depending on the sensitivity of the Personal Information and your relationship with us. You may designate an authorized agent to make a request on your behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent. We may require written proof of the agent’s permission to make a request on your behalf, or we may need to verify your identity directly.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain Personal Information as permitted by law, such as for tax or other record keeping purposes, to maintain an active services account, and to process transactions and facilitate client requests.

Please note: These rights and processes may not apply to Personal Information we collect as a company providing services to our clients. For requests related to a third party, please contact that third party directly. Clients with requests can reach out to their account contact.
For purposes of applicable law, please note the following regarding how we collect and use your Personal Information as described in this Policy, including in the previous 12 months:

  • We collect, use, and disclose for our business and commercial purposes certain categories of Personal Information, including: Identifiers; customer records information; commercial information; Internet or other electronic network activity information; general location data; and inferences. See Section 1 above for additional detail. We collect and use these categories of Personal Information for the business and commercial purposes described in Section 3 of this Policy. We collect these categories of Personal Information from the sources described in Section 2, above.
  • We may disclose each of these categories of Personal Information for our business and commercial purposes described in Section 3, and to the categories of third parties described in Section 4 of this Policy, in each case to the extent permitted by applicable law.
  • We may “sell” or “share” the following categories of Personal Information in connection with cross-context behavioral advertising: Identifiers; commercial information; Internet or other electronic network activity; general location data; and inferences. We may “sell” or “share” these categories of Personal Information to the categories of third parties described in Section 4 and Section 5 of this Policy, which may include business and marketing partners, data analytics providers, social media platforms, and data brokers (to the extent permitted by applicable law).

7. Transferring your personal information.

We are generally based in and store data in the United States. We may transfer information that we collect about you to affiliates and to other third parties across borders and to other countries around the world. Other countries, including the United States, may have privacy laws that are different from those where you live. By submitting your personal information or engaging with the website, you consent to this transfer, storage, or processing.

8. We use standard security measures and keep information as needed.

We use standard security measures designed to keep your information safe. The Internet is not 100% secure, though. We cannot promise that your use of our sites or services will be completely safe. We encourage you to use caution when using the Internet. This includes not sharing your passwords.

We keep personal information as long as it is necessary to fulfill the purposes we collected it for or relevant for the practices described in this Policy. We also keep information as otherwise required by law. The criteria we use to determine our retention policies include the length of our relationship with you, your requests, your continued use of our sites, ongoing obligations such as contracts and services, and our legal obligations.

9. Our site is not intended for individuals under 18.

Our websites and apps where this Policy is found are generally meant for adults. We do not knowingly collect personally identifiable information from children or any individuals under 18. If you are a parent or legal guardian and think your child has given us information, you can contact us at techsupport@orchestraco.com. Please mark your inquiries “Children’s Information Request.”

10. We may link to third party sites or services we don’t control.

If you click on a link to a third party site or platform, you will be taken to a property we do not control. This Policy does not apply to the privacy practices of third parties. Read the privacy policy of other websites and platforms carefully. We are not responsible for these third parties or their policies.

12. We may update this Policy.

From time to time we may change our privacy practices. We will notify you of any material changes to our Policy to the extent required by law. We will also post an updated copy on our sites. Your continued use of our websites and apps means that you consent to the collection, use and disclosure of your personal information as set out in the updated Policy.
